APPROVED MINUTES OF THE REGULAR MEETING
OF THE KENTWOOD CITY COMMISSION
HELD APRIL 11, 2011
Commission Chambers

Mayor Richard L. Root called the meeting to order at 7:00 P.M.


Reverend Jerry DeRuiter of Kentwood Community Church gave the invocation.


Commissioner Clanton led the Pledge of Allegiance to the Flag.


Roll Call: Present: Commissioners: Sharon R. Brinks, Robert Coughlin, Richard Clanton, Frank Cummings, Raymond VerWys and Mayor Richard L. Root.


Motion by Coughlin, supported by Clanton, to excuse Commissioner Brown with prior notification.


Motion Carried.


Staff Present: Fire Chief Jim Carr, Finance Director Tom Chase, Economic Development Planner Lisa Golder, Deputy Administrator Rich Houtteman, City Clerk Dan Kasunic, Deputy Fire Chief Brent Looman, Police Chief Rick Mattice, Community Development Director Terry Schweitzer, Fire Department Administrative Assistant Nancy Shane, City Attorney Jeffrey Sluggett, Assistant Finance Director/Purchasing Agent Phil Tietz, Public Works Director Ron Woods and Recreation Director Charlie Ziesemer.


Ten (10) citizens and members of the news media attended the meeting.


Motion by Brinks, supported by Clanton, to approve the agenda with the following addenda: add 9(a) presentation by Planning Dept., 9(b) announcement from Fire Chief, 9(c) presentation by Commissioner Clanton and 10(b) receive and file Preliminary Budget for Fiscal Year 2011-2012.


Motion Carried.


CONSENT AGENDA:


Motion by Brinks, supported by Coughlin, to approve the Consent Agenda as follows:
1.Receive and file minutes of the Committee of the Whole held March 15, 2011.2.Resolution 20–11 to set a May 15, 2011 public hearing date to consider an application for an Industrial Facilities Exemption Certificate in the City of Kentwood for Paladin Industries, Inc. located at 4900 West Greenbrooke Dr., SE, under Act 198.3.Authorize purchase of three (3) replacement mobile radios from Tele-Rad, Inc. at a total cost of $9,696.08 for the Police Department with funds from drug forfeitures. 4.Resolution 21–11 to adopt the First Amendment to the City of Kentwood Employee Pension Plan.5.Resolution 22–11 to adopt the First Amendment to the City of Kentwood Defined Contribution Pension Plan and Trust.6.Resolution 23–11 to approve the reprogramming of the 2010-2011 Walnut Hills-Stanaback Park and 2011-2012 Walma Connector Non-Motorized Projects to utilize Kent County Community Development Block Grant funds by June 30, 2011.7.Payables for the City totaling $1,272,375.61.

Resolutions Adopted.

Motion by Cummings, supported by Clanton, to approve the minutes of the March 15, 2011 City Commission Meeting.


Motion Carried.


PRESENTATIONS AND PROCLAMATIONS:


Community Development Director Schweitzer reviewed all aspects of the Planning Department.


Fire Chief Carr announced his retirement as of June 24, 2011 and spoke of his years at the City of Kentwood.


Commissioner Clanton presented a plaque from the Michigan Municipal League thanking Mayor Root for his work.


COMMUNICATIONS AND PETITIONS:


APPROVAL OF FIREWORKS DISPLAY PERMIT FOR THE INDEPENDENCE DAY ACTIVITIES 2011 BY MELROSE PYROTECHNICS.
Motion by Brinks, supported by Coughlin, to approve the fireworks display permit for the Independence Day Activities 2011 by Melrose Pyrotechnics.


Motion Carried.


PRELIMINARY CITY GENERAL FUND BUDGET FOR FISCAL YEAR ENDING JUNE 30, 2012.
Motion by Clanton, supported by Cummings, to receive and file the Preliminary City General Fund Budget for Fiscal Year ending June 30, 2012.


Motion Carried.




PUBLIC HEARING:


Abaco Group LLC.
Mayor Root opened the public hearing to transfer the Industrial Facilities Exemption Certificate No. 2007-065 and to transfer the Industrial Facilities Exemption Certificate No. 2006-154 issued to Surefil LLC to Abaco Group LLC.


Following a brief presentation by Economic Development Planner Golder and company representatives Steven Morren and Bruce Deiterle.


Motion by Brinks, supported by Clanton, to close the public hearing.


Motion Carried.


The Commission discussed the prior abatements with Surefil, the new company and proposed payback agreement.


Motion by Brinks, supported by Cummings, to postpone action until the May 4, 2011 City Commission Meeting.


Motion Carried.


Lacks Exterior Trim Systems LLC.
Mayor Root opened the public hearing to approve the establishment of an Industrial Development District and approve an Industrial Facilities Exemption Certificate in the City of Kentwood for Lacks Exterior Trim Systems LLC located at 4365-52nd Street, SE; under Act 198.


Following a brief presentation by Economic Development Planner Golder and Tony Sokol:


Motion by Cummings, supported by Coughlin, to close the public hearing.


Motion Carried.


ADOPT RESOLUTION 24–11 TO ESTABLISH AN INDUSTRIAL DEVELOPMENT DISTRICT FOR LACKS EXTERIOR TRIM SYSTEMS.
Motion by Brinks, supported by Coughlin, to adopt Resolution 24–11 to establish an Industrial Development District in the City of Kentwood for Lacks Exterior Trim Systems LLC located at 4365-52nd Street, SE; under Act 198.


Roll Call Vote: Yeas: Brinks, Clanton, Coughlin, Cummings and Root.
Nays: VerWys. Absent: Brown.

ADOPT RESOLUTION 25–11 TO APPORVE AN INDUSTRIAL FACILITIES EXEMPTION CERTIFICATE FOR LACKS EXTERIOR TRIM SYSTEMS.
Motion by Brinks, supported by Coughlin, to adopt Resolution 25–11 to approve an Industrial Facilities Exemption Certificate in the City of Kentwood for Lacks Exterior Trim Systems LLC located at 4365-52nd Street, SE; under Act 198.

Motion by Brinks, supported by Cummings, to adjourn to Closed Executive Session to consider the purchase of land as permitted under Section 8(d), P.A. 267 of 1976, as amended by Act 256 of 1978, Michigan’s Open Meeting Act.


Motion Carried.

COMMENTS OF COMMISSIONERS AND MAYOR:


Commissioner Coughlin will not be at the April 21st 4:30 P.M. City Commission Meeting.
