ORDINANCE COMMITTEE

Present: Chairperson Robert Coughlin, Frank Raha III and Mayor Richard L. Root. Absent: Sharon R. Brinks. Also: Finance Director Tom Chase, City Clerk Dan Kasunic, Assistant Finance Director/Purchasing Agent Phil Tietz, Deputy Administrator Keith Van Beek and Public Works Director Ron Woods.
1. PROPOSED ORDINANCE TO AMEND SUBSECTION 54-174(A) OF THE CODE OF ORDINANCES, REGARDING CONSTRUCTION WORK IN PUBLIC RIGHT-OF-WAY.
Public Works Director Woods explained, that as the ordinance is written presently, any contractor working within the City requires a permit and must indemnify the City. However, if work is being done as contracted by the State, the State does not indemnify anyone. He stated the proposed language change is to clarify the City?s Ordinance regarding required permits of work in public right-of-ways. The Committee discussed the State authority and language within the proposed amendment. After a brief discussion, the Committee requested legal review and to return the proposed amendment to the Ordinance Committee Meeting in February.
2. PROPOSED ORDINANCE TO AMEND SECTIONS 2-405 AND 2-407 OF THE CODE OF ORDINANCES, REGARDING PURCHASING RULES AND TO AMEND RESOLUTION 79-03 WHICH ADOPTED POLICIES AND PROCEDURES FOR THE SALE OF CITY PROPERTY AND SERVICES.
Assistant Finance Director Tietz explained this proposed amendment is to reduce work load and to clarify specifics since the adoption of the original ordinance and resolution in 2003. He spoke at length pertaining to standard vendors and the guidelines that are used.
Motion by Root, supported by Raha, to recommend to the City Commission to amend Sections 2-405 and 2-407 of the Code of Ordinances, City of Kentwood, Michigan, regarding purchasing rules and a resolution to amend Resolution 79-03 that adopted policies and procedures for the sale of City property and services.
Motion Carried.
