Present: Chairperson Robert Coughlin, Frank Cummings and Mayor Root.
Absent: Sharon R. Brinks and Frank Raha III.
Also present: Deputy City Clerk Mary Bremer, Community Development Director Terry Schweitzer, Deputy Administrator Keith Van Beek and Public Works Director Ron Woods.

1. PROPOSED ORDINANCE TO AMEND THE CODE OF ORDINANCES,
APPENDIX A ? ZONING ORDINANCE, SECTION 2.02A TO DELETE
ASSISTED LIVING FACILITY AND INCLUDE ASSISTED FAMILY
FACILITY AND ASSISTED LIVING GROUP FACILITY.
Community Development Director Schweitzer reported the Planning
Commission has recommended approval of the changes after some study.
The driving force behind the proposed amendments was a desire to treat
facilities providing care for adults that same regardless of whether they
were licensed by the State of Michigan. He reported that they had met
with the neighbors from the proposed Beacon Hill Condos project on
Forest Hill Ave. to get their input for the ordinance changes.

Motion by Cummings, supported by Root, to recommend to the City
Commission to approve the proposed ordinance to amend the Code of
Ordinances, Appendix A ? Zoning Ordinance, Section 2.02A to delete
Assisted Living Facility and include Assisted Living Family Facility and
Assisted Living Group Facility.

Motion Carried.

2. PROPOSED ORDINANCE TO AMEND THE CODE OF ORDINANCES,
APPENDIX A ? ZONING ORDINANCE, BY CREATING SECTION
16.02AA REGARDING ELECTRONIC MESSAGE CENTERS.
Community Development Director Schweitzer noted the Planning
Commission had spent some time studying neighboring municipalities?
guidelines and concerns with regard to timing changes, size of the board,
brightness, etc. before recommending approval of this ordinance
amendment. Chair Coughlin expressed some reservations with the
proposed allowance of changing messages throughout the day. He is
seeking the perspective from the Police Chief with regard to the
distraction it may represent to motorists.

Motion by Root, supported by Cummings, to recommend approval of the
proposed ordinance to amend the Code of Ordinances, Appendix A ?
Zoning Ordinance, by creating Section 16.02AA regarding electronic
message center regulations, but to place this item on the next Com-
mission agenda under Standing Committee section for further discussion.

Motion Carried.

3. PROPOSED ORDINANCE TO AMEND THE CODE OF ORDINANCES,
APPEENDIX A ? ZONING ORDINANCE, BY AMENDING SECTION
8.03.C.1 REGARDING OPEN AIR VEHICLE SALES PARKING.

Community Development Director Schweitzer reported that this section
of the Zoning Ordinance needed addressing since the customer parking
required for such sales took a rather large portion of the lot leaving less
area for display. Again, the Planning Commission reviewed area
municipalities? requirements and recommended the change to the
ordinance.

Motion by Cummings, supported by Root, to recommend approval of the
proposed ordinance to amend the Code of Ordinances, Appendix A ?
Zoning Ordinance, by amending Section 8.03.c.1 regarding Open Air
Sales Parking.

Motion Carried.

ORDINANCE ENFORCEMENT REPORTS.
Community Development Director Schweitzer reviewed the process used to provide a vendor service for some of the ordinance violations and how the fees were determined.
