ORDINANCE COMMITTEE

Present: Chairperson Robert Coughlin, Sharon R. Brinks, Ray VerWys and Mayor Richard L. Root. Also present: Deputy Administrator Rich Houtteman, City Clerk Dan Kasunic, Community Development Director Terry Schweitzer, City Attorney Jeff Sluggett and Public Works Director Ron Woods.

1. PROPOSED ZONING ORDINANCE AMENDMENTS TO ADDRESS MEDICAL MARIHUANA DISPENSARIES, FENCES AND SEMI-TRACTOR/TRAILER PARKING AND STORAGE IN RESIDENTIAL AREAS.
Director Schweitzer explained there are three parts to this Zoning Ordinance amendment. The first section pertains to the zoning restrictions of dispensaries. The Committee discussed what kind of penalty was involved with this and the request of the Committee to make the violation of this section of the ordinance a criminal misdemeanor and to have staff make changes to the ordinance. Staff reviewed the section pertaining to fencing and noted that staff still would need to compile a list of all fences currently erected that will be grandfathered. He stated there will be a public hearing September 20th for these proposed amendments. The Committee requested staff obtain feedback from fence companies. Staff informed the Committee that an exemption to tractor trailers to give the ability for paper drives to be held without violating the ordinance.
