APPROVED MINUTES OF THE REGULAR MEETING
OF THE KENTWOOD PLANNING COMMISSION
MARCH 13, 2007, 7:30 P.M.
COMMISSION CHAMBERS



A. Chair McIntyre-Evenocheck called the meeting to order at 7:30 p.m.

B. The Pledge of Allegiance was led by Commissioner Holtrop.

C. Roll Call:
Members Present: Betsy Artz, Ray Poyner, Laurie Sheldon, Dan Holtrop, Abed Itani, Nancy McIntyre-Evenocheck, Ed Swanson, Frank Vander Hoff, and Chris Winczewski.
Members Absent: None
Others Present: City Attorney Jeff Sluggett, Community Development Director Terry Schweitzer, Planner Debargha Sengupta, Staff Secretary Monique Collier, the press and the applicants.

D. Approval of the Minutes and Findings of Fact

The following corrections were noted: Mr. Nightem?s correct spelling of his name is Nydam and should be corrected throughout the minutes; and on page 3, Winczewski suggested in the minutes that it should read that the children will be supervised 24/7.

Motion by Swanson, supported by VanderHoff, to approve the Minutes of February 27, 2007 as corrected.

H. Public Hearing

Case # 3-07- Wedgwood Christian Services ? Preliminary Approval of a PUD Development Plan and Final Site Plan Approval of Phase 1 and Special Land Use for a Child Caring Institution ? located at 3227 ? 36th Street
Planner Sengupta introduced the request. He stated that the plan would require three deviations to the front yard setback, side yard setback and rear yard setback. It would also require a variance from the zoning board of appeals for the non-residential parking setback and the landscape buffer associated with the non- residential parking setback. He stated that there is not much of a concern with the variances or the deviation. It is a distance from the Huntington Glen Apartment buildings and there will be a row of trees separating the facility from the apartments. He stated that the applicant has agreed to talk to the apartment management about the facility and any issues that they may have. Sengupta stated that the applicant is proposing that three parking spaces be deferred for the second phase of the development. He stated that the site has constraints with the floodplain and wetlands which minimize the upland area available for development. He stated that there will be some wetland mitigation required with the second phase of the development. He stated that one of the concerns that came up at the work session related to the use of the building, a description was provided with the recommendation and a representative was asked to be present to explain the operations and the uses of the building. He stated that also at the work session, there was a suggestion to look at reorientation of the building; but the applicant?s engineer stated that the grades would not allow a walk out if it is reoriented. He stated that there were concerns about the landscaping and there were some revised plans included in the packet that shows some landscaping detail. He stated that a more detailed landscaping plan will have to be reviewed and approved by staff. There was also a question regarding the transit routes close to the facility. Sengupta stated that information was obtained from the Rapid and there are two different plans, one is the existing service on 44th Street and 32nd Street. It has been proposed that 44th Street will be re- routed and it would be routed through 32nd street. Either way there will only be one transit route close to the facility with a stop at Shaffer Avenue and 32nd Street. He stated that the development is otherwise in compliance with the zoning ordinance.

Mick McGraw was present to answer question regarding the construction management of the site. He is a board member of Wedgwood.

McIntyre-Evenocheck opened the public hearing.

Motion by VanderHoff, supported by Artz, to close the public hearing.

Chair McIntyre-Evenocheck asked if the neighbors had been contacted. Applicant Paul Nydam, the facility director stated that they have contacted the neighbors. He stated that he spoke to the resident manager Lori Way who has been the manger for six years. She stated that they had expected the site to be developed at some point. She indicated that Wedgwood has always been good neighbors and their only concern would be to maintain good communication with them about any concerns that may arise over time. Mr. Nydam stated that he assured her that lines of communication would continue to be open and once the Leader and Staff Program Manger arrive on site they will introduce them to her and provide them as a direct contact for any concerns

Secretary Winczewski stated that he is concerned about the variances. He stated that he thinks the zoning ordinance should be followed and expects others to do the same thing. He stated that he doesn?t have a problem with the use, but he has problems with the site plan.

Commissioner Sheldon asked when they were looking to develop the rest of the land. Mr. McGraw stated that they are not sure; they are looking at 2-4 year vision plans. He stated that within the next six months to nine months they will be back in front of the planning commission.

Artz stated that she thinks that Wedgwood is a wonderful organization and she supports the project.

Poyner stated that he is in favor of the project.

Motion by Holtop, supported by, Poyner, to grant conditional approval of a Special Land Use for a Child Caring Institution for Wedgwood Christian Services (North) as described in Sengupta?s memo dated 3/8/07. Approval is conditioned on conditions 1-5 and basis points 1-7.

Motion by, Holtrop, supported by VanderHoff, to recommend to city commission conditional approval of a preliminary site plan dated February 2, 2007 for RPUD-1 High Density Residential Planned Unit Development for Wedgwood Christian Services as described in Sengupta?s memo dated 3/8/07. Approval is conditioned on conditions 1-11 and basis points 1-11

Motion by Holtrop, supported by Artz, to grant conditional approval of the Final PUD Site Plan dated February 2, 2007 for Phase 1 of the R-PUD-1 High Density Residential Planned Unit Development for Wedgwood Christian Services (North) as described in Sengupta?s memo dated 3/8/07. Approval is conditioned on conditions 1-9 and basis points 1-7.

1. Commissioners? Comments

Chair McIntyre-Evenocheck asked what will be on the agenda for the next meeting. Schweitzer stated that there was a request for an ordinance amendment dealing with signs that may come up and there are a number public road project that are being designed. McIntyre-Evenocheck asked about the CIP. Schweitzer stated that it will be ready for work session on April 10 and the Public hearing on April 24. The previously noticed public hearing will have to be opened on March 27 and adjourned to April 26.

Chair McIntyre-Evenocheck stated that she received a letter concerning the Wyoming Planning and Development Master Plan. It is online in electronic format or you may call their office for a paper copy.

2. Staff?s Comments

Sengupta stated that there is a draft recommended land use for Sections 13 and 34 and they have requested that the Parks and Recreation and Engineering Department provide information on utilities and future parks and trails and where we can see street connections

McIntyre-Evenocheck stated that we should have an administrative meeting to lay out some plans as to what we want to see happen.

Schweitzer stated that April 12 & 13 are the main days for involvement for the Charrette. Schweitzer stated that July 4th is the 40th Anniversary for the City and the Recreation Department is giving community groups an opportunity to take part in the parade celebration. We could locate former members of the planning commission and invite them to ride on the float or walk in the parade.
