APPROVED MINUTES OF THE REGULAR MEETING
OF THE KENTWOOD PLANNING COMMISSION
MARCH 9, 2010, 7:30 P.M.
COMMISSION CHAMBERS



A. Chair Holtrop called the meeting to order at 7:30 p.m.

B. The Pledge of Allegiance was led by Commissioner Groce.

C. Roll Call:
Members Present: Betsy Artz, Maurice Groce, Dan Holtrop, Ed Swanson, Frank Vander Hoff, Don Yokom, Johngerlyn Young and Chris Winczewski.
Members Absent: Laurie Sheldon (with notification)
Others Present: Community Development Director Terry Schweitzer, Economic Development Planner Lisa Golder and Staff Secretary Monique Collier.

Motion by Commissioner Winczewski, supported by Commissioner VanderHoff, to excuse Commissioner Sheldon from the meeting.

D. Approval of the Minutes and Findings of Fact

Motion by Commissioner Winczewski, supported by Commissioner VanderHoff, to approve the Minutes of February 23, 2010.

E. Approval of the Agenda

Motion by Commissioner VanderHoff, supported by Commissioner Artz, to approve the agenda for the March 9, 2010 meeting.

G. Old Business

Case #10-09 ? Consideration of a Street Tree Regulatory Ordinance.
Director Schweitzer stated he will present to the commissioners a revised recommendation relating to the street tree requirements at the March 23, 2010 meeting. He stated staff is taking a look at ?break away? trees. He stated he has talked to the police chief and he is pleased with the direction working toward break away trees in the median area. Schweitzer stated he has also had dialogue with the landscape architect, that designed the median treatments from Kalamazoo through Shaffer Avenue. The architect stated not only were they going to look at trees, but also bushes and grasses that can provide some volume. Schweitzer stated this should not cause personal injury and probably limited personal property damage. Schweitzer stated he will have more literature on March 23 for the commissioners consideration.

Winczeswki asked staff to also look at street classifications instead of speed in gauging the minimum setbacks and spacing of trees.

H. Public Hearing

Case #2-10 ? Quaker Steak & Lube - Special Land Use and Site Plan Review for a Drive-thru restaurant located at 4515 28th Street SE

Planner Golder introduced the request. She stated this is a reuse of an existing building at 4515 28th Street, formerly Damons. She stated the only reason this request is before the commission is because of the drive up window. She stated there are some land use standards that are not met 1) the setback on every side should be 50 feet in which they do not meet therefore the applicant will be going to the Zoning Board of Appeals on March 15. 2) a requirement that interparcel vehicular access is made whenever possible. She stated on the initial site plan it shows there is a 13% greenspace which is not enough to meet Zoning Ordinance requirements. She noted it is corrected on the March 8 site plan.

Golder stated she is recommending conditional approval of the special land use and site plan review for a drive through restaurant.

Dale Honiker, with Guilts and Associates, franchisee for Quaker Steak & Lube was present to represent the request. He displayed a menu/book of how the Quaker Steak & Lube Restaurants look and operate. He stated in the restaurants there will be cars and bikes and memorabilia hung on the walls and suspended from the ceiling. He stated there are other Quaker Steak & Lube Restaurants in Pennsylvania, Virginia, Ohio, Tennessee and West Virginia. He stated the pick up window is designed for people to call ahead, place an order, come on their way home and get their food without having to wait in line.

VanderHoff asked where they came up with the name Quaker Steak and Lube. Mr. Honiker stated it was because of its initial association with Pennsylvania Quaker State Lube and Oil that was the popular at that time thing in Pennsylvania. He stated they have talked to Quaker Stake and Lube Oil Company and got their permission to use that name. He stated it was a bonus for them because you go into the restaurant and see huge Quaker Stake and Lube oil cans that go up on the shelves, they get free publicity.

Yokom asked how many employees they anticipate. Honiker stated they will start with 180 employees and usually end with about 120 full/part time people. Yokom asked about the hours of operation. Honiker stated the prep guys come in around 8 and the clean up guys will be there until about 2-3a.m.

Artz asked if they plan to do anything with the outside of the building. Honiker stated the outside of the building will be different than what it is now.

Yokom asked when they hope to be open. Honiker stated they would like to be open in June, hoping it would be a 90 day build period to get it open.

Winczewski asked about the traffic flow of someone coming in to pick up their food. His concern was what conflicts might happen in the parking lot if there is some stack up. Bill Mast stated they see maybe two cars at a time in the drive up window and there will not be an issue, they will have plenty of room.

Bill Mast stated as far as schedule the building plans have been completed and they hope to be under construction in 2-3 weeks.

Chair Holtrop opened the public hearing.

Motion by Commissioner Artz, supported by Commissioner VanderHoff, to grant conditional approval of the Quaker Steak and Lube Special Land Use Drive Through Restaurant as described in Case No. 2-10. Approval is conditioned on conditions 1-4 and basis points 1-5 as described in Golder?s memo dated 3/4/10.

Motion by Commissioner Artz supported by Commissioner VanderHoff, to grant conditional approval of the site plan dated March 8, 2010 for Quaker Steak and Lube Special Land Use Drive Through Restaurant as described in Case No. 2-10. Approval is conditioned on conditions 1-7 and basis points 1-5 as described in Golder?s memo dated March 3, 2010.
