Minutes for 11/15/2011

Present: Chairperson: Michael W. Brown, Richard Clanton, Ray VerWys and Mayor Richard L. Root. Also present: Commissioners Sharon Brinks, Robert Coughlin, and Frank Cummings. 1. VARIANCE TO MAINTAIN A CHAIN LINK FENCE IN A DRAINAGE AND FLOODWAY EASEMENT BY LATASHA CATCHING AT 4740 CONDUCTOR COURT.
DPW Director Woods reviewed the communications with the homeowner. The Homeowner reviewed her communications and responses of the City pertaining to what was allowed in 2002 and 2005. It was noted by staff that the problem of the fence being in the floodway did not come to the City’s attention until the last installation of the fence and was then determined it encroached into the floodway. The Committee asked questions and discussed the problem.

Motion by VerWys, seconded by Root, to deny the request for a variance to maintain a chain link fence in a drainage and floodway easement at 4740 Conductor Court and must remove the fence from the easement by May1, 2012 and to have staff give direction of placement of the fence pertaining to the pool set-back and the floodway as to what the City will allow.

Motion Carried.

2. CODE INSPECTION SERVICES AGREEMENT WITH THE CITY OF WYOMING
City Engineer Kepley reviewed his memorandum dated November 15th regarding the agreement.

Motion by VerWys, seconded by Root, to recommend to the City Commission to approve the Code Inspection Services Agreement with the City of Wyoming as permitted under PA 35 of 1951 & PA 8 of 1967.

Motion Carried.
