APPROVED MINUTES OF THE REGULAR MEETING
OF THE KENTWOOD ZONING BOARD OF APPEALS
CITY COMMISSION CHAMBERS
FEBRUARY 16, 2009, 7:30 P.M.



1. Chair Lenger called the meeting to order.

MEMBERS PRESENT: Mel Halloway, Garrett Fox, Richard Lenger, Alan Lipner, Ed Swanson and Don Yokom
MEMBERS ABSENT: Tom Cutts and Les Derusha,
OTHERS PRESENT: Planner Joe Pung, Staff Secretary Monique Collier and the applicant.

Motion by Commissioner Swanson, supported by Commissioner Fox, to excuse Cutts and Derusha from the meeting.

3. Approval of the Minutes and Findings of Fact

Motion by Commissioner Swanson, supported by Commissioner Fox, to approve the minutes of December 2008.

4. Public Hearing

Appeal #V-09-01

Applicant: John House (Grand Rapids Building Repair, Inc)
Location: 5859 Castle Brook Avenue, SE

Request: The applicant wishes to restore an existing home which was damaged by fire. The existing home is nonconforming with respect to front yard setback and the cost to restore the home exceeds its State Equalized Value (SEV). The Kentwood Zoning Ordinance requires that where the restoration costs of a nonconforming building or structure exceed its SEV the building or structure must be built in conformance with the requirements of the zoning district in which it is located unless the Zoning Board of Appeals permits the rebuilding or restoration of the building or structure. The request is for permission from the Zoning Board of Appeals to restore the home at its current location.

John House with Grand Rapids Building Repair, 5825 MaryAnn Dr. Greenville, MI was present to represent the request. He stated the 5859 Castle Brook had a fire in the basement area, the kitchen and the dining room. He stated they are going to take the section of the living room and dining room right down to the foundation and an unfinished space in the basement that they will gut out and build back up. He stated that all the houses in the area are about the same distance from the road and have funny shaped lots. He stated is be an insurance claim project and the insurance company won?t pay to tear the rest of the house down and move it. He stated if this doesn?t get approved the owner will likely demolish it and try to sell the vacant lot. Mr. House stated the foundation appears to be okay.

Holloway asked if they intend to only knock down the left half of the house. Mr. House stated that is correct, the walls on the main floor are all okay, but the floor joist are burned.

Fox asked if there are going to be modification done to the home. Mr. House stated it was for sale and the homeowner moved to Florida; he is going to keep it on the market and sell it. There are no changes to be made and they intend to keep it exactly like it is.

Vice Chair Lenger opened the public hearing.

There was no public comment

Motion by Commissioner Swanson, supported by Commissioner Fox, to close the public hearing.

Motion by Commissioner Lipner, supported by Commissioner Fox, to approve V-09-01 in that (b) there are circumstances that the land previously occupied by the non-conforming use does not permit the reasonable construction of the non-conforming building or structure in a manner that would make the structure conforming. The whole structure was not destroyed, the existing foundation will be used.

Thanks to Meadow Brook Elementary for their hospitality in hosting our City Commission Meeting this week.  It was great to engage our northeast citizens as well as get to know Principal Shaw and and his staff.  Such great things happening at Meadow Brook Elementary!

The Kentwood City Commission will hold its May 21st 7p meeting at Meadow Brook Elementary at 1450 Forest Hills SE. We are excited to “take our show on the road” and engage our northerly residents!

  • 28th Street Construction

    Resurfacing M-11 from Breton Avenue east to Patterson Avenue, and reconstructing M-11 from Patterson Avenue east to I-96 will take place from March through November of 2013.  Work also includes the addition of a right-turn lane, new sidewalk with ramp upgrades compliant with the Americans with Disabilities Act, municipal lighting and traffic signal upgrades.
